These Terms & Conditions (“Terms”) govern your access to and use of brorents.com and BroRents services, including renting, listing, and purchasing equipment (the “Platform”). By creating an account, making a booking, or listing gear, you agree to these Terms.
“Bro,” “Bro’s,” “BroRents,” “us,” and “Platform” refer to the service operated at brorents.com. “You” means the person or entity using the Platform. If you use the Platform for a business, you represent that you have authority to bind that business.
You must be 18+ and capable of entering a binding contract.
Create one account per person or entity and keep credentials secure.
Bro may require identity checks (e.g., photo ID, proof of address, selfie, card verification) and may decline, suspend, or terminate accounts at Bro’s discretion.
Renters book and use equipment.
Owners/Vendors (including Bro for Bro’s own inventory) list equipment for rent and/or sale.
For third-party listings, Bro provides the marketplace and payment rails; unless expressly stated, Bro is not the owner or operator of third-party gear and is not a party to those rental contracts.
Owners/Vendors must provide accurate titles, specs, condition notes, photos, prices, deposits, and availability.
Prices, fees, deposits, and taxes are shown at checkout; currency is FJD unless noted.
Bro may correct obvious errors, update availability, or cancel bookings where necessary (e.g., suspected fraud).
A booking is confirmed only after full payment (and any required security deposit or pre-authorization) is captured.
Bro may place a hold (pre-auth) on your payment method up to the stated deposit or replacement value.
You authorize Bro to charge your payment method for: rental price, add-ons, deposits, overages, late fees, damage/loss, cleaning, replacement, toll/permit fees, and taxes.
Bro may use third-party processors. You agree to their terms and any KYC checks.
Deposits/pre-auths help cover damage, loss, theft, late returns, missing accessories, and other charges.
If no issue is reported at return/inspection, the deposit/hold is released per processor timelines.
If charges apply, Bro may deduct from the deposit and charge any balance due.
(Owners/Vendors may set stricter policies; the policy shown at checkout controls the booking.)
72+ hours before pickup/delivery: refund of rental fees minus 5% processing.
24–72 hours: 50% refund of rental fees.
<24 hours / no-show: no refund.
Custom orders, hired operators, and delivery fees are non-refundable once arranged.
If equipment becomes unavailable due to reasons outside Bro’s control, Bro will refund rental fees paid (delivery and incidental costs excluded) or offer a comparable substitute where possible.
Bring valid ID and the payment card used.
Inspect and test the kit at handover; note any issues before leaving.
Risk of loss transfers to the Renter upon pickup/delivery and remains until the kit is returned and checked in.
Use gear carefully, lawfully, and as intended by the manufacturer.
No sub-renting, pawn/sale, or allowing third parties to use the kit without written approval.
Do not use gear in hazardous environments without proper rigs, safety, and insurance.
You are responsible for media management and backups; Bro is not liable for data loss.
Return by the agreed time to the agreed location, with all accessories, caps, cases, media, batteries.
Late returns: daily rental rate plus a late fee (up to 1.5× daily rate) and any losses caused to the next booking.
Cleaning fees apply for excessive dirt, moisture, smoke, sand, or odor.
Missing or damaged accessories are charged at replacement cost.
You are responsible for any damage, loss, or theft from handover to check-in.
Charges may include: repair, parts, labor, diagnostics, shipping, loss of rental income, and if not repairable, full replacement value (new for old where required).
You must immediately notify Bro of any incident and provide a police report for theft.
Opening, modifying, or servicing gear without authorization voids coverage and triggers full liability.
If Bro offers an optional Loss/Damage Waiver (LDW) at checkout, it reduces but does not eliminate your liability. LDW is not insurance and excludes: negligence, gross misuse, water/sand ingress, open-air theft, cosmetic damage, missing items, and breach of these Terms.
Bro may require you to hold production insurance naming the Owner/Vendor and Bro as loss payee/additional insured for high-value bookings.
You warrant you own the gear or are authorized to rent it and that it is safe, compliant, and well-maintained.
You must keep listings accurate and promptly block out unavailable dates.
You are responsible for tax compliance (including any FRCS obligations), invoicing if required, and declaring income.
Payouts are net of Bro’s marketplace fees, payment processor fees, adjustments, and applicable taxes.
If you cancel a confirmed booking without good cause, Bro may charge a cancellation fee, reduce listing visibility, or suspend your account.
Bro’s platform, service, and processing fees are displayed at checkout.
Prices may exclude VAT/GST or other taxes where applicable; taxes will be calculated and shown before payment.
Receipts/tax invoices are issued electronically.
Reviews must be truthful, relevant, and non-abusive.
Bro may remove content that violates law, privacy, IP, or these Terms.
Illegal surveillance, harassment, defamation, obscenity, wildlife/heritage violations, or any unlawful use.
Circumventing fees, manipulating bookings, scraping, reverse engineering, or security testing without written consent.
Interfering with Platform integrity or other users’ listings.
The Platform, logos, and brand elements are Bro’s IP.
Listing content remains the Owner/Vendor’s IP, but you grant Bro a non-exclusive, royalty-free license to host, display, and promote your listings on and off Platform.
Bro collects and processes personal data as described in Bro’s Privacy Policy (see site footer).
You consent to receiving transactional emails/SMS about bookings, payouts, and account security.
Except as required by law, the Platform and gear are provided “as is” and “as available”.
Bro does not guarantee uninterrupted availability, error-free operation, or that gear will meet your specific production outcomes. Test before use.
To the maximum extent permitted by law, Bro is not liable for lost data, lost profits, consequential, special, or indirect damages.
Bro’s total liability for any claim is limited to the amount you paid for the booking that gave rise to the claim.
You agree to indemnify and hold harmless Bro and Bro’s officers, employees, and agents from claims, damages, and costs arising from: your use of gear, breach of these Terms, violation of law, or infringement of third-party rights.
Bro isn’t liable for delays or failures caused by events beyond Bro’s reasonable control (e.g., natural disasters, strikes, outages, government actions).
Bro may suspend or terminate accounts, cancel bookings, or remove listings to protect users, comply with law, or prevent fraud/abuse.
You may close your account unless there are open bookings, unresolved claims, or balances.
Bro may update these Terms. Material changes will be posted on the site with a new effective date. Continued use after changes means acceptance.
These Terms are governed by the laws of the Republic of Fiji.
Disputes should first be raised with Bro’s support for resolution. If unresolved, you agree to the exclusive jurisdiction of Fiji’s courts in Suva.

Renter: person or entity renting and using the gear.
LDW: optional loss/damage waiver (not insurance) when offered.
